TERMS OF SERVICE

These Terms of Service (“Terms”) govern all services provided by APG (Autopia Garage), operated by Avento Holdings Pty Ltd (ABN 82 674 622 863) (“we”, “us”, “our”), to any client (“you”, “Client”).

By booking, authorising, or receiving any service from us, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

These Terms apply in conjunction with any signed Service Agreement, invoice, booking confirmation, or written communication. Where applicable, the signed Service Agreement prevails for service-specific terms.


1. SERVICES

We provide automotive enhancement services including, but not limited to:

  • Paint Protection Film (PPF)

  • Ceramic and graphene coatings

  • Vinyl wrapping and custom wraps

  • Related surface protection and enhancement services

Services provided are collectively referred to as the “Services”.


2. BOOKINGS & COMMENCEMENT

Services commence on the confirmed booking date.
Bookings are not secured until a deposit is received.

We reserve the right to refuse service at our discretion, including where vehicle condition, undisclosed history, or safety concerns exist.


3. STANDARD OF WORK

All Services are performed with reasonable care and skill in accordance with:

  • Australian Consumer Law (ACL)

  • Industry standards applicable to automotive detailing, wrapping, coating, and protection films

Results may vary depending on vehicle condition, age, prior repairs, paint history, and existing defects.


4. VEHICLE CONDITION & DISCLOSURE

You acknowledge that vehicles may contain pre-existing conditions including, but not limited to:

  • Scratches, chips, oxidation, or clear coat failure

  • Prior resprayed or repaired panels

  • Weak or previously damaged paint

  • Undisclosed defects or poor prior workmanship

We are not responsible for the worsening or exposure of any pre-existing condition.

You are responsible for disclosing all prior paintwork, wraps, coatings, repairs, and modifications before services commence.


5. PAYMENTS

5.1 Deposits

A 20% non-transferable deposit is required to secure all bookings.

5.2 Final Payment

The remaining balance must be paid in full upon completion and prior to vehicle release.

5.3 Payment Methods

Accepted payment methods are determined at our discretion.

5.4 Fees

Merchant and processing fees are strictly non-refundable.

5.5 Price Adjustments

Prices may change if additional labour, materials, or hidden defects are identified. Approval will be sought prior to proceeding.


6. CANCELLATIONS & RESCHEDULING

  • 48+ hours’ notice: Deposit refundable or credited (less processing fees)

  • Less than 48 hours: Deposit forfeited

  • No-show: Up to 100% of service cost may be charged

One reschedule is permitted with 48+ hours’ notice. Further changes may incur additional fees.

Where materials (PPF, vinyl, coatings) have been ordered, cut, or allocated, the Client is responsible for the full material cost, enforceable as liquidated damages under NSW law.


7. SERVICE-SPECIFIC TERMS

7.1 Paint Protection Film (PPF)

  • PPF is not invisible

  • Minor seams, lift lines, dust inclusions, or stretch marks are acceptable characteristics

  • PPF reduces but does not eliminate impact damage

  • Removal of old film may damage weak or resprayed paint

Manufacturer warranties apply and exclude damage caused by impact, chemicals, neglect, or improper care.

7.2 Ceramic & Graphene Coatings

  • Not scratch-proof, chip-proof, or etch-proof

  • No washing permitted for 5–7 days

  • Proper aftercare is required for warranty eligibility

Manufacturer warranties apply only to product defects.

7.3 Vinyl Wrapping

  • Vinyl is not paint

  • Minor seams, visible edges, and adhesion variation may occur

  • Weak or resprayed paint may lift during installation or removal

Warranties exclude environmental damage, pressure washing, chemical exposure, or impacts.


8. CLIENT RESPONSIBILITIES

You agree to:

  • Remove all personal and valuable items from the vehicle

  • Disclose all relevant vehicle history

  • Follow all aftercare instructions

  • Inspect the vehicle upon collection

We are not responsible for personal items left in the vehicle.


9. FINAL INSPECTION & ACCEPTANCE

You must inspect the vehicle at collection.

Once the vehicle leaves our premises:

  • All work is deemed accepted

  • Warranty terms apply

  • New damage cannot be attributed to us


10. STORAGE FEES

Vehicles not collected within 24 hours of completion may incur storage fees of $45.00 per day.


11. LIABILITY & RISK

To the fullest extent permitted by NSW law, we are not liable for:

  • Pre-existing damage

  • Mechanical or electrical failures

  • Sensor or camera malfunctions

  • Damage caused by prior workmanship

  • Environmental damage (weather, animals, theft, vandalism)

  • Client negligence or improper aftercare

You accept all risks associated with work performed on repaired or repainted panels and the removal of films, wraps, or coatings.


12. INDEMNITY

You agree to indemnify and hold harmless APG (Autopia Garage) and Avento Holdings Pty Ltd from any loss arising from:

  • Incorrect or incomplete information

  • Undisclosed defects

  • Improper use or care

  • Failure to follow aftercare instructions

  • External or environmental damage after collection

This indemnity survives completion or termination of services.


13. TERMINATION

Either party may terminate services in writing.

Upon termination, you remain liable for:

  • All materials ordered or allocated

  • All labour completed

  • Any applicable cancellation fees

We may withhold vehicle release until all outstanding amounts are paid.


14. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia, including the Australian Consumer Law.


15. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the parties and replace all prior discussions or representations.

No amendment is valid unless made in writing and agreed by both parties.
